- 1. Any Import duty, taxes, surcharge, levy etc., present or future, as per regulations of
- importing country shall be to Buyer’s account.
- 2. Seller to submit the shipping documents as follows: 3 2 Commercial Invoice, 3/3 Original
- Bill of Lading, 1 2 LDC Certificate of Origin, 3 2 Packing List, 1 2 Phytosanitary Certificate,
- 1 2 Fumigation Certificate, 1 2 Weight and Quality Certificate, Non GMO Certificate (part of
- Quality Certificate)
- 3. If the material is not cleared within 15 days of arrival of cargo/ documents whichever is
- later, the shipper holds the right to consider the contracted quality as landed quality and
- B/L weight as landed weight.
- 4. Risk of the material is transferred to buyer upon loading of material at port of loading and
- the ownership of the material is transferred to buyer upon full payment of sale value to the
- seller.
- 5. Contract signed & exchanged per fax or e-mail to serve for the purpose of originals and
- holds full legal value in all respect unless followed by the originals.
- 6. The buyers shall provide at the request of seller a No Objection Certificate (NOC) to
- transfer the cargo to any other buyer without any claims in case the buyer defaults to clear
- the cargo before filling of the IGM by the shipping line. This document is only for clearance
- in case of default.
- 7. Weight difference up to 0.5% at the discharge port is acceptable as per International
- Standards.
- 8. Tolerance of /- 10% is allowed for both quantity and value.
- 9. The goods shall be inspected prior to shipment by any independent surveyor at the load
- port at seller’s cost who shall issue a Certificate of Approval to load the goods specifying the
- actual quantity and quality and this will be final at load port and binding on both parties.
